Right to Reside Case

Hey I’m a Welfare Rights Advisor in Liverpool and have quite a tricky Right to Reside case.

Client is a 61 year old man from Italy who’s currently in a care home and being funded by Social Services. He’s in receipt of DLA LRM as he must have made the claim before 8.4.13.

He’s very confused and unwell so difficult to get much fact out of him. From the information I have it would seem he’s lived in England in the 70s and possibly was working in this period. There’s a possibility he may of had a daughter, though social services have not been able to track her down.

He’s come back to the UK a couple of times and been in and out of mental health services since the 80s. He’s been back in the UK for roughly 7-8 years and was sectioned about 7 years ago.

I have a date of birth, NI number and an NHS number.

Any advice on where to start on a case like this, I have some experience of Right to Reside cases, but this one seems like a bit of a wild goose chase.

Oh and the DWP have decided to suspend his DLA as they’ve heard he’s had a change in circs.
