ESA during appeal - med cert demanded
Wed 30-Dec-09 03:54 PM

Hi

My client has been told she can only have "appeal ESA" when she has provided a med cert covering the relevent period.

This can't be legit can it? Has anyone any experience of challenging similar demands?

Thanks
Dan

I think that is correct, she does have to send in sick notes. Appealing extends the assessment phase, and you need a sick note during the assessment phase.

The question is whether they are correct to demand a fresh sick note after the appeal has been made when the previous sick note hasn't run out yet. That's what they ask for here.
