Overpayment of I.S

Hi all
I've just received the submission regarding my client and an o/p of I.S. She claimed I.S in July 05 and included her partner who had different surname. He had previously claimed Incapacity Ben but this was suspended pending query over medical evidence. When I.S awarded client rang to ask why partner's ICB was being taken into account when it wasn't being paid. DWP duly checked and awarded backdated I.S to take this into account.

Partner then has ICB claim reinstated and arrears paid to cover whole period of time when I.S had been adjusted. Client did not inform I.S office.

ICB office abatement procedures then failed to recover monies as partner's surname was not linked to client's.

As always i did not have the full story from client, her recollection was rather different. I don't think she has much of a case to argue if facts are as read, seeing as she was aware how the ICB affected her I.S and i've checked Section 74(2) and 74(4)(a).

Any point in going on with this one?
