I read about case law a while back but cannot find it. This involed the onset of income support if the claiment did not meet the cotributions conditions the DWP are refusing to backdate income support

could you perhaps clarify the background to your client's problem a bit more?

its a bit difficult to see what case law might be relevant without a fuller background as to, for example, what benefits they may have applied for, and when and why they did so.

My was in reciept of SSP until it expired a claim was then submitted for incap the decision came back incap could not be paid due to not enough contributions credits only a claim for income support was then submitted but the dwp would not backdate incap backdated credits
