Disregarding maintenance paid
Wed 07-May-08 09:54 AM

I've just enjoyed a lengthy exchange of views with a 'Fathers 4 Justice' type of person, who strongly objects to the fact that Housing and Council Tax Benefit don't give him a 'disregard' for the maintenance he pays out.

Of course they don't! Commissioner Mesher spelt it out clearly many years ago...

Unfortunately, apparently all this means is that the time is right to make a new challenge, probably using the Human Rights Act, or something.

Call me timid, but I can't actually see any way of - or any point in -doing this. But if anyone can identify the error in my analysis, I'd be keen to hear about it.

It may not be quite so straightforward, the chap concerned *may* have a case depending upon circumstances.

Have a look at CH/1672/2007
