New statutory instrument

New regulations have been issued in relation to eligibility for housing and homelessness assistance for people who have limited leave to remain granted under the Ukraine Scheme Appendix to the Immigration Rules following an application for leave that was made in the UK.

In force from 22 June 2022, the Allocation of Housing and Homelessness (Eligibility) (England) and Persons Subject to Immigration Control (Housing Authority Accommodation and Homelessness) (Amendment) (No. 2) Regulations 2022 (SI.No.601/2022) -

• amend the Allocation of Housing and Homelessness (Eligibility) (England) Regulations 2006 so as to ensure that people who have limited leave to remain granted in accordance with the Ukraine Scheme Appendix to the Immigration Rules having made their immigration application from within the UK, are eligible for an allocation of housing accommodation and for housing assistance; and
• amend the Persons subject to Immigration Control (Housing Authority Accommodation and Homelessness) Order 2000 so as to enable housing authorities in Scotland and Northern Ireland to provide housing accommodation and housing authorities in England, Scotland and Northern Ireland to provide homelessness assistance to those people.

Update (9 June 2022) - the commencement date for the regulations has been amended to 10 June 2022 by the Allocation of Housing and Homelessness (Eligibility) (England) and Persons Subject to Immigration Control (Housing Authority Accommodation and Homelessness) (Amendment) (No. 3) Regulations 2022 (SI.No.626/2022).
