Amendment of commencement date for regulations relating to housing and homelessness assistance for people granted leave under the Ukraine Scheme Appendix of the Immigration Rules

New statutory instrument corrects ‘inadvertent’ error to bring coming into force date forward to 10 June 2022 as originally intended

New regulations have been issued to amend the commencement date for regulations relating to eligibility for housing and homelessness assistance for people who have limited leave to remain granted under the Ukraine Scheme Appendix of the Immigration Rules.

The Allocation of Housing and Homelessness (Eligibility) (England) and Persons Subject to Immigration Control (Housing Authority Accommodation and Homelessness) (Amendment) (No.3) Regulations 2022 (SI.No.626/2022) amend SI.No.601/2022 (the No.2 Regulations) to replace the coming into force date of 22 June 2022 with 10 June 2022.

The explanatory memorandum to the new regulations advises that the later date was inserted into the No.2 Regulations -

'… due to an inadvertent error … although the correct timing for coming into force was contained in the header section, it was not reflected in the body of the Regulations, despite the fact that the same was intended.'

The memorandum continues –

'The Secretary of State believes that it is necessary for [the (No. 2) Regulations] to come into force at the earliest opportunity because of the need to provide support to those unable to return to Ukraine due to the Russian invasion of 24 February 2022, who are granted leave to remain via the Appendix Ukraine Scheme of the immigration rules. Delay to the legislation coming into force will prevent those in need within this cohort from being eligible for housing and homelessness assistance.'
