conditionality and partners
sorry for being lazy and not very intelligent but..
does conditionality apply to partners. For example, if one in a couple was a 35 hr carer (or in support group) and therefore has ‘no work related requirements’ what about the partner? does s/he have full conditonality??
I have tried to look it up honest!
That’s my understanding. Both members of a couple have to accept whatever commitment applies to them unless one is pension age, abroad, in education or in prison.
That’s right. To claim jointly, both of them would need to meet the basic conditions (including the work related requirement for both them where applicable.)
Exceptions would be where the partner who doesn’t meet the basic conditions has either reached pension credit age or in is FTE.
There are also limited circumstances where a member of a couple is able to claim as single person (where the partner is under 18/not resident GB/in prison.)
(that is s3(2) and s4(2) WRA 2012; draft UC reg 3 )
