ESA - can IR premiums still be added to contributions award

Hi,

I have a client who is on contributions based ESA standard with support group element.  It looks like she has not been receiving the EDP or the SDP that she should be entitled to.  Can she ask for this to be awarded as IR ESA now before she has to migrate?  She has a migration date of 18/10/24 due to receipt of HB. 

Also, if she can request them is there a minimum period that she needs to be in receipt of them before she is able to have them protected under transitional protection.

The information I have been able to find is a bit contradictory

Is it definitely an old-style Contributory ESA claim? When was the claim made and when was full service UC rolled out to your area? If the ESA dates from after the rollout then no she won’t be able to. If it’s from before then it should just be a phone call to ESA to ask them to reassess, expect an ESA3 form to arrive shortly thereafter. Though it might be quite tight on time now. I wonder if this is a situation where an extension could be granted to the migration period?

I’m not sure there’s any minimum period as the TP is based on the circumstances when they claim I think? But I will confess I’m a bit weak on this area!
