Can a PIP review which was instigated by the claimant contacting DWP to report worsening health conditions be stopped once DWP has issued the claimant a new form? DWP has sent a new form to the client which has to be returned by 18 April. Can a claimant change his mind and stop the process?

It used to be that sometimes the DWP helpline would be prepared to ‘cancel’ the process if you rang up and asked nicely, for example if the claimant had reported the change based on some misunderstanding. Whether that is still true, I don’t know.

However there is no formal right to end the review process once it has begun. The DWP have required your client to provide information within the meaning of reg 8 of the PIP Regs and should he not do so, his award will likely be brought to an end.

Thanks for the quick response. As I suspected. Unfortunately he went ahead and requested supersession without seeking advice first on the potential pitfalls of doing so.
