Applying for council tax reduction where partner has no recourse to public funds

Good afternoon

I’m helping a client apply for council tax reduction (CTR). I wondered if anyone had any experience of advising “mixed” couples, where one partner had NRPF.

Scenario:
Client lives with their partner. Client is a British citizen; partner is on a family visa that expires in 2023. Conditions of leave include no recourse to public funds (NRPF).

My understanding is that, if my client got extra CTR as a result of their partner’s presence (for example, because my client no longer qualified for the single-person discount), their partner would breach the NRPF condition and any current or future right to remain in the UK could be affected.

I’ve asked the local authority to confirm if our client would get any extra CTR and, if not, how to reference their partner and NRPF condition of leave on the application form. An automated reply says that it could be 28 days before they get back to me!
