Whilst it’s never strictly necessary to write witness statements in benefit tribunals, I have occasionally found it helpful to set out a client’s evidence in the form of a CPR compliant witness statement, especially in cases which depend on a complex set of facts (e.g. right to reside cases with lengthy work histories) or where you would like to have a third party give evidence where they might not be able or willing to attend a hearing.
