Personal injury claim and means tested benefit
Hi, we have a client, currently on reduced hours and in receipt of means tested benefits. She is due a pay out from a personal injury claim (at work). Are there any exemptions so that our client does not lose her means tested benefits? We were looking at the option of a trust fund? Any guidance would be very much appreciated. Kind regards.
You don’t say what means tested benefits but in general there is a 12 month disregard and if put into trust during that 12 months it will continue to be disregarded.
