pension credit delay

Client is on ESA. She reaches pension age on 9/12/21 and has been told (correctly) that her ESA will stop then . She will be eligible for PC as well as SRP so she claimed both as soon as she could. The Pension Service have apparently told her that “they won’t look at” the PC claim until after 9/12/21, so she will inevitably run into financial trouble straightaway.

Has anyone else had this issue and has it been raised via a stakeholders forum?

When we met DWP officials yesterday, they said they were confident they were getting back on top of the delays by the end of October but part of their strategy for doing so was to prioritise the people who are due payments in the here and now.

However, that’s a very different thing from saying they won’t even look at the PC claim until she hits SPA. The problem is what to do in order to try and expedite a decision, as I’m not sure whether something like sending an LBA before she would actually be entitled would be feasible or not?

We’re hoping to establish some kind of formal escalation route with the Pension Service but that’s also not really much help to your client at this stage. Maybe try escalating through a formal complaint about the fact she has made her claims well in advance and does expect to have a seamless transition when her ESA award expires?
