Hi there

Grateful for any thoughts. I am clear that in scenarios where someone’s partner has leave but is nil recourse, they should be physically on the UC claim and then deemed ineligible. Does the same apply for partners who are asylum seekers and/or those here on tourist visas? I.e. those who do not have leave of any kind in the UK. We’ve had a couple of sticky ones and I’d be grateful for clarity. Are they couples for benefit purposes?

Related to this, those claims seem to get stuck on the NI requirement but as I understand, this should be ignored when the person is ineligible.
