Withdrawing appeal- hearing date is in a fortnight

Hi all,

Just wondering what is the procedure in withdrawing a PIP appeal? My client is very anxious and has suddenly decided that they want to withdraw the appeal and don’t even want it decided on the papers. Anyone have experience of how to go about withdrawing it?

You just tell the tribunal that the appeal is withdrawn and that is it. This could be in writing or on the phone. The clerks will then register it as withdrawn and you will get a letter to say it has been withdrawn and hear no more about it.

The only exceptions are either if the withdrawal application is made at a hearing, or if the tribunal has given a specific direction that a withdrawal will not take effect without the tribunal’s consent. In these circumstances the Tribunal would need to agree to a withdrawal so there would need to be some judicial input before the withdrawal took effect.

An application for reinstatement can be made within a month of the withdrawal but will not automatically be granted.
