If you claim UC to top up SSP, is there a chance that you will be asked to undergo a WCA after three months, assessed as fit for work and potentially be required to look for work (or return to work) even though your GP is continuing to renew your sick notes and SSP continues in payment?

If the answer is “no” is that because of practice, or is there a regulation that applies?

If you claim UC and notify health condition then you should be referred for a WCA on day 29. The outcome is clearly not guaranteed and you could be found Fit for Work. However for a claimant (without children on the claim) getting a WCA decision of even LCW would have the benefit of then establishing entitlement to a Work Allowance thereby increasing the Uc payable.

Thank you for replies.

In this case the client is likely to be signed off work for stress caused by his child’s serious illness, in circumstances where there is a good chance that he wouldn’t be found to have LCW, let alone LCWRA, if a WCA was carried out.

As he has children he would already qualify for a UC work allowance irrespective of LCW status.

Financially it probably makes sense for him to move from tax credits to UC, but not if this means he becomes subject to work-related requirements while getting SSP.
