Can I ask for some quick advice please. My client was awarded IIDB at 100% in February 2021. The award was backdated to October. They immediately contacted the LA as they were receiving HB and CTS. Both have now stopped and an o/p of HB has been calculated. Is there any way of getting the o/p up to the date they contacted the LA written off?

You would need to argue that the delay from October to February at the DWP end amounted to an official error.  That will depend whether it was unnecessary delay or whether these things genuinely take time to investigate, or whether there was third party delay beyond DWP’s control.

Otherwise, no official error means the HB o/p is recoverable.  Council has discretion not to recover but there is no obvious reason why they wouldn’t do so in this case.
