SDP, Non-resident carer
Hopefully a straightforward query.
I have a client who lives in a 2 bedroom flat.
He gets IR-ESA (to include the support component). He gets PIP at the enhanced rate for both daily living and mobility.
He gets maximum HB on his eligible rent figure.
His friend may move out next year and client intends to then live alone.
We have told him that he may be entitled to the SDP as a part of his IR-ESA as he gets PIP – DL, lives alone and no one claims carers allowance in respect of him.
We have told him that as he has an extra bedroom he will be subject to the bedroom tax at 14%.
He will be better off overall financially.
We have told him that in his circumstances if he has a non-resident carer then this will mean that the extra bedroom will not negate his HB.
My question is that having a non-resident carer will have no impact on the SDP (that is it does not signify a non-dependent living with you) – is that correct?

Yes - they’re non-resident and therefore are not living with them - sdp is fine :)
ps obviously the non-resident carer needs to be overnight at least some nights to get rid of bedroom tax

Is this a joint tenancy?
If that is the case, your client may already be entitled to the SDP.
EDIT: See CPAG 20/21 p. 363 for who doesn’t count as a non-dependant (and thereby not for the SDP).
