Hello

I have a case where the sole-tenant lives in temporary accommodation with her mother (no dep) who is in receipt of UC.  The tenant lost her job and decided to become a FT student, and she is no longer entitled to HB.
The mother has claimed HB, relying on regulation 8 (liable person is not paying).  The claim has been refused and we are considering an appeal.

I would appreciate any thoughts on this, and any case law that you are aware of?
