Overpayments and duty to disclose

I’m sure someone posted on here recently about a failure to disclose overpayment appeal, whereby the tribunal hadn’t followed HInchy and B and had decided there was no recoverable overpayment.

Have searched and can’t find this, anyone got any ideas?

We’ve got chaotic client who asked for PIP reassessment, they stopped her award and she didn’t tell Pension Service so was overpaid SDP until an AA award was made. I think it’s arguable she didn’t understand what was going on, particularly because PIP messed her about something rotten for more than 12 months.

We’re also trying to submit late appeal for the PIP as we’re just inside the 13 months but I’d like to try and challenge the o/p in the meantime anyway.
