Hi,

I think the dwp are correct

Client getting IS based on CA, carer for son

Client didn’t send renewal form back before deadline so DLA stopped

CA stopped based on DLA decision

IS getting paid as a carer ends, with eight week carers run on

DLA assessed and awarded, from 24-11-19, gap created, as old claim ended on 17-11-19, and CA rewarded and backdated from 24-11-19

DWP refuse new claim to IS, as client in uc area, and say can’t backdate to earlier claim, or revise the previous decision as when made correct I.e client not a person entitled as CA has stopped, and even when CA reinstated means gap of a week, can’t argue that IS stops and restarts

Anybody think a work around or that it is a claim to UC?

I might be missing something here but if DLA ended 17/11/19, then DLA and CA started again on 24/11/19, can’t IS revise the decision to end the award as CA was in back in payment during the 8-week IS run-on? I had one like this earlier in the year and IS did revise…
The revision would be on the basis of a decision that applies retrospectively, ie if the DLA decision was made fairly instantly on the claim, then would have been able to re-claim CA and continue the IS without any gaps.
