Cases needed - Advance payment recovery at 30% of standard allowance

I am looking for UC claimants who applied for an advance payment which is now being recovered from their UC payments at a rate exceeding 15% of their standard allowance.

Recovery of such payments at a rate of 30% appears to be standard practice. CPAG intends to challenge this in judicial review proceedings as the UC Regulations set a maximum recovery rate of 15% of the standard allowance.

Hi all,

Further to Lynsey’s post in June last year, CPAG are still looking to challenge the rate of advance payment recovery (the changes to the deductions rate that came in in April 2021 do not affect the argument we had identified previously).

Below are the details if you come across anyone who might be interested.

CPAG are hoping to challenge the rate of recovery of UC advance payments via judicial review. 

CPAG is looking for claimants who:
• took out an advance payment at the start of their UC claim (made at any time); and
• are currently repaying that advance at a monthly rate which is higher than 15% of their standard allowance (if repayments are not taken from earned income) or higher than 25% of their standard allowance (if their repayments are deducted from earned income)
