UC LCWRA element in hospital for long term patients vs. ESA support group
I’ve just started a new project based in a mental health unit with a lot of long term patients. Many of them are receiving ESA and are in the support group but are not being paid the support group element or EDP as they have been in hospital for more than 52 weeks.
I cannot find any equivalent rule in UC. If these patients were to make UC claims, should they be paid the LCWRA element from the start of the claim or is there something I’m missing? Has anyone dealt with a similar situation?

We deliver a similar project in a couple of hospitals in Somerset and have come to the same conclusion as you regarding the ESA -v- UC options.
We are advising clients of the pro’s and con’s of ending an ESA claim and claiming UC so they make an informed decision and proceeding accordingly - whilst wondering how long it will take for the UC legislation to be amended!
