There is a case which is probably heading my way.  Couple living together and she is the victim of domestic violence.  She is from India and I don’t think she has any family here so still living with partner while planning her escape.  She has no income of her own and he controls everything.  She has indefinite leave to remain so claims JSA as single person.  Refused because of ‘partner’s’ income.

I’m not looking for any advice here around LTAHAW issues.  But, I seem to remember something (maybe a piece of case law) stating that on the facts of a particular case evidence of estrangement because of domestic violence could bury any notion of LTAHAW in a case like this.  Can anybody else remember this or did I dream it?

I found what I was looking for.  I didn’t dream it.  It was on a discussioon forum from last year and a cd was cited.  However, if anyone knows of any other case law the citation would be appreciated.
