in the cases where i have had permission to appeal to the ut i would say a clear majority have been refused on application to the FT.

i wouldnt be too critical of yourself on the evidence issue either. for one, it may well have harmed the case depending on what it said, more importantly its rare to get evidence that directly addresses the activities unless you ask for that and even then some tribunals will place little weight on it unless it explains how the opinions have been arrived at.

not sure if they still do it but cpag scotland in the past done training on finding errors of law and ut work which i found useful.
