Was asked for advice from someone today who has applied for compensation under the Windrush Scheme 5 months ago, has been advised that his claim is being held up as they are waiting for information from the DWP in relation to his UC claim.  Client has called the helpline and unsurprisingly has got nowhere with this.  Does anyone know how the DWP are dealing with these cases and how the client can chase this up?

I also wondered if anyone was sure how awards of compensation from this scheme will be treated by DWP for those with means tested benefits?. I had a look in CPAG but think it was published before compensation scheme came into being.

Hi CHC-  see para 14 below from HB circular A8/2019 Windrush Compensation Scheme and HB - how LA should treat payments made under the WCS


13. Compensation payments made by the Home Office under the WCS and the Windrush Exceptional Payments scheme should be disregarded for HB purposes on an extra-statutory basis with the agreement of HM Treasury. No amendments will be made to HB regulations.

14. The extra statutory provision applies to anyone in receipt of HB or any of the other income related benefits. Any payments made to claimants in respect of the WCS should be disregarded for the purposes of income or capital calculations indefinitely.
