UCHE ayt main address, HB at temp accom out of area , UCHE has ended and DHP requested

Hello Lovelies
Customer in our area living in private rented accomm, UCHE in payment - all good.
Customer laves property due to DV and moves into temp accomm in neighbouring authority - HB is in payment at temp accomm.
Customer has requested a DHP as UC stopped the Housing Element at her main residence and she now has arrears.
We’ve looked at UC regs and while there are provisions for DV and temp absence, it looked like they would only pay UCHE at main property if UCHE was also in payment for her temp accomm - but that seems a bit harsh/bizarre.

Apparently she has been back to UC (with her landlord assistance) and they are adamant she cannot get UCHE at the main residence.

Im happy that she satifies criteria for a DHP (becusae she is getting HB at the temporary accomm out of area)  but im not sure its appropriate to pay it if UCHE should be covering at least part of the costs at her main residence.
so - basic question - should UC be paying her housing element while she is temp absent from main residence?

Para 6(3) of Schedule 3 to the UC Regs applies here.  The claimant does not meet the payment condition for one of the two dwellings but may receive a UC housing element on the other if DWP considers it reasonable.  So really it ought to be UC paying the rent on the normal home.

UC should be paying for the private accommodation. This situation comes within para 6(3) of Schedule 3 to the UC Regs, as she does not meet the payment condition in respect of the temporary accommodation (see Schedule 1, para 3(i)).
