Potentially significant ECtHR judgment: New UK housing benefit regulation (the “Bedroom Tax”) discriminated against a woman who had suffered domestic violence.

Imposition of Bedroom Tax on women living under “Sanctuary Scheme” arrangements was discriminatory and breached ECHR.

ECtHR: Woman at risk of domestic violence was part of Sanctuary Scheme whose aim was to allow victims of domestic violence to remain in their homes. While the aim of the bedroom tax was to incentivise her to move. This was an irreconcilable conflict, and breached human rights.

ECtHR: In context of domestic violence States have a duty to protect people from threats, including where their right to enjoyment of their home free of violence is at stake. ECHR breached in this case. 10,000 EUR award.
