Mixed-age couple on WTC and HB

Having a brain fade moment here. MAC where older partner was working and claiming WTC, reached SPA on 06.03.19 and claimed HB from 01.04.19 and continuous entitlement ever since. Only other income is wife’s CA.

This is definitely a pension-age HB claim and therefore savings provisions apply and PC claim now possible? This is because it’s only the presence of ESA/IS/JSA that would muddy the waters under reg.5 of HBSPC Regs?
