ESA and SDP, after UC in payment

Apologies if this has been discussed elsewhere. Cl originally on ESA with WRA component and pursuing PIP appeal. Found not to have LCW in Feb 2019 so claimed UC. PIP DL has now been awarded on appeal and backdated to 2017. ESA appeal is ongoing. Can cl ask for transitional SDP payments in UC backdated to start of UC claim? Any recourse re ESA claim and SDP as no existing award?

They should definitely be able to get SDP added to the ESA award up until the point it ended (it doesn’t matter that the ESA award is not currently in existence). They would also then be entitled to the transitional SDP payments.
This case is not dissimilar to the case in para 7.51(b) here.

Thanks Charles, had already looked at para 7.51, just wanted to check. So letter to ESA asking for a revision. Note already on UC journal asking for transitional SDP payments.
