ESA to JSA to UC

Client failed WCA in August 2017, he claimed JSA in September 2017 (still live UC service area) and then UC in December 2017

We helped him to appeal against August Decision and were successful at an tribunal hearing last week (found to have LCWRA)
Client subsequently had a WCA for his UC claim in April 2018 and so has received the LCWRA since that date.

Does the fact that he claimed JSA between his ESA and UC claim make any difference or will he be paid the LCWRA element from the August 2017 to April 2018?

Yes. What should happen is that his original ESA award should continue, including the support component, until the date of the UC claim, and the UC decision should be revised to include the LCWRA element from the start of the claim. But I think you’d be lucky to get all that without a fight.
