Dear All

We have a client who has had a partner move in, so has lost the SDP, as no longer lives alone.

Can she simply add him to her ESA claim, as received the SDP in the last month?

We note that as well as needing to amend ESA claim, that cl also needs to claim CTC, as the partner has a child.

So in short my question is although she has lost the SDP, but received in the last month, does the exemption still apply if lost SDP because of such a change?

Just want to double check and make sure

Because the change means that SDP protection is lost (assuming partner is not disabled themselves, qualifying them for joint SDP) then they are not exempt.  They will need to make a joint UC claim.

Unfortunately no as does not meet the second criteria:
(a)is, or has been within the past month, entitled to an award of an existing benefit that includes a severe disability premium; and
(b)in a case where the award ended during that month, has continued to satisfy the conditions for eligibility for a severe disability premium.”
