Birmingham council’s application for interim injunctions to prevent industrial action was dismissed - Birmingham City Council v UNITE the Union & Anor [2019] EWHC 478 (QB) (01 March 2019).

Main issue determined is -

Unite and UNISON respectively have, following the ballots called on its members to take industrial action.  It is not in issue that but for the statutory protection under the Trade Union and Labour Relations (Consolidation) Act 1992 (“TULRCA”), an action could be brought based on inducement to breach of contract.  The primary issue is whether or not the protection under s.219 of TULRCA applies, and in particular whether the effect of s.222 of TULRCA is to remove the protection in this case. (paragraph 3)

Another trade union rights case if of interest…

... the High Court in Independent Workers’ Union of Great Britain, R (on the application of) v Central Arbitration Committee & Ors dismisses appeals by the Independent Workers’ Union against two decisions of the Central Arbitration Committee that rejected its applications to be recognised for collective bargaining purposes at two workplaces under Schedule A1 to the Trade Union and Labour Relations (Consolidation) Act 1992.
