I have a tenant who is a live in carer, gets Income Support, Carers Allowance and DLA in her own right. Both qualify for severe disability premium, but Carers Allowance would need to be cancelled. concerned that UC would be triggered. any views!

Duh, should have known, UC can’t be claimed.

There is a chicken-and-egg problem here I think.  If the claimant is only eligible for IS because s/he is a carer, IS will end as soon as CA stops.  That means s/he won’t get the SDP, and that in turn will mean that s/he cannot make a new claim for ESA(ir).

How long have they been on IS?  There was a thread last week in which underlying old-style incapacity for work was relied on to preserve IS in a similar case.

Would they not still qualify for IS on the basis of IS Regs Schedule 1B paragraph 4(a)? That only requires that you are regularly and substantially involved in the care of someone who gets AA, DLA (MRC/HRC) or PIP (DLC) which presumably would still be the case even if they weren’t getting CA anymore?

can they claim conts based esa under the relaxed rules for carers? this would mean carers wouldn’t come into payment and give them the sdp with the longer term pending an outcome of the wca?

Why can’t she get an SDP for herself before ending the CA claim? In any case, she should backdate that and not simply wait till she ends the CA.
