A client was in receipt of fostering and then adoption allowance, which is disregarded as income for IS.  However she saved it to use for ongoing medical needs of the child (I’m not sure if it was in her account or if she set up an account in the child’s name) and didn’t declare it.  The capital took her over £16,000 and she has a massive IS o/p.  Any ideas of how this could be challenged?
