CH/3244/2007 is reference by Shelter HB Handbook in relation to direct payments to landlord - anyone have a copy handy?

Anyone have any experience of how easy/difficult it is to challenge decision by council to pay HB direct to landlord?

Not coming up on the old UT site. More to the point, the commentary in the latest Findlay doesn’t reference it in relation to either reg. 95 or 96.

‘The claimant had not paid the rent and left the property. Arrears of Housing Benefit were paid to the landlord. The claimant disputed this and said he was in dispute about repairs. A Tribunal has decided it was in the overrising interest of the claimant to receive the HB outstanding but the Upper Tribunal disagreed. It was a fact that the arrears exceeded 8 weeks and there was little evidence about the alleged disrepair. Accordingly, the UT remade the decision to award the outstanding HB direct to the landlord’.
