PSIC and work allowance

Hypothetical…. Client and his wife have two children aged 1 and 3. Wife is PSIC with NRPF condition. She is currently primary carer. Cl is in receipt of UC as a workseeker with the standard allowance for a single person, a housing costs element and child elements. Wife has found a job earning around £800 pcm. This income will be taken into account for the UC claim (CPAG p1537). He will become primary carer. A work allowance would seem to apply as they have children- will this be deemed to breach the no recourse to public funds condition attached to wife’s leave?

You need to advise them to get immigration advice before doing anything else.

If she either takes up the job and/or claims benefits, she could breach the terms of her right to remain in the country and be subject to prosecution or deportation.
