Overpayment following MR

Help appreciated. Client awarded standard rate DL, no M. Asked for MR and decision has been changed, not entitled to either and DL overpaid. Is this recoverable?

Who can say for certain without more facts?

Is the DWP saying it is recoverable? If so, on what basis?

They haven’t written to her about the OP yet, it is mentioned in the MRN. I’m guessing that they will say the original decision was incorrect and rectified on MR.

It’s normal (old?) rules. If its the result of misrepresentation or failure to disclose, it might be recoverable. Otherwise, it probably isn’t.

Thanks Elliot. I’m sure they’ll try their hardest to recover it but it look like they just changed the decision on MR.

I don’t think its very common for PIP to try and recover in this sort of situation. I wouldn’t give it a second thought unless the decision notice turns up.

I’ve seen a few PIP letters refer to an overpayment when benefit has been stopped, but I’ve never seen them try to recover it yet.
