Hi

A client was in a property, claiming HB with 3 children, pre April 2017. She then had to move, and then new HB claim includes only two children - as the LA consider this to be a ‘new claim’

If you move within the same LA is this not just a change of address rather than a new claim?

Any ideas would be welcome

Sounds dubious to me. I would think it’s the same claim, just with a change of circumstances.

Furthermore, does she get CTC for 3 children? The 2 child limit does not apply if a claimant receives child tax credits that include an elements for more than 2 children (ie. where all the children were born before April 2017). This is dealt with in reg. 22 of the HB regs.
