Temporary Accommodation Again

Hi we have a client who has chosen to live in B & B. UC are refusing to pay Housing Costs as they are classing it as temporary accommodation ,HB are refusing to pay as he has not been placed there on a temporary basis but self referred. Any thoughts ?

It’s not “temporary accommodation” if it hasn’t been provided to the claimant in pursuance of the LA’s obligations under homelessness legislation or in order to prevent homelessness - see ADM Memo 4/18 at para 20.
