This was a policy intent in Esther Mc Veigh’s June Statement on UC but does anyone know if it has been enacted yet or whether UC are accepting it as a fait accompli and diverting these claimants to legacy benefits, I keep hearing stories that they are and I was wondering what other peoples experiences have been.

The draft regulations would insert a new reg 63(1) into the UC (TP) Regulations which would prevent claims for UC by SDP recipients.  The consultation is open until 20 August. The draft regs are not yet law and have no effect as of today.

SDP-claimants are still required to claim UC.

Thanks for the reply, the only reason I raised it again was that I keep hearing stories that claimants are being allowed to claim legacy benefits and I was wondering if this was actually the case and if so if it was widespread
