Bedroom tax exemption and Universal Credit

I have a client whose HB claim ended in Feb when she claimed Universal Credit with HC. She is a social housing tenant who was deemed to be liable (and continues to be liable under UC) for the 25% bedroom tax. I have just successfully argued with the local authority that she should have been exempt from bedroom tax as she had had continuous entitlement to HB and occupation of the same dwelling since before 1/1/96.
This has resulted in a backdated payment of HB arrears. 
Now that she is on UC should that same exemption apply?

No unfortunately not. In fact it ended in HB as well from March 2014 so the HB arrears will only run up to that point.

I suspect not, I’m afraid.  That provision (left in the bedroom tax regs ‘by accident’ of course) was specific to continuing awards of HB.  I don’t see a legislative way that this carries through into UC, which is a different benefit governed by its own regulations.

Thanks that clears it up for me.  I had expected the exemption to run only up to March 2014 myself but the council have applied it for the whole period up to Feb 2018.
