I’m hoping someone may be able to help with this scenario.  It’s becoming increasingly common for providers of exempt accommodation as UC rollout continues.

We have a number of hostels in full UC areas.  Residents can make a new housing benefit claim to help with rent costs, as a new claim for housing benefit is still permitted under the 2014 transitional regs in respect of exempt accommodation.

New claims for other legacy benefits are not possible under the transitional regs, so residents must claim UC to help with daily living costs instead of legacy benefits (JSA, ESA, etc).  They are therefore both HB and UC claimants.

A move to independent accommodation in the same local authority area should be considered a change of circumstances for HB purposes.  Residents should therefore not be affected by the transitional regs as it’s not a new HB claim.

As such, do they remain entitled to housing benefit following the change of address to independent accommodation?  Their UC would continue for daily living costs, but HB would continue for rent costs.

No because you cannot get HB for independent accommodation at the same time as UC so therefore the HB award would come to an end and your client will have to claim for housing costs via UC
