Hi all

Does anyone know whether the guidance provided to the Immigration Tribunal about whether individual states/prvinces etc is available publicly anywhere?

Thanks

I’m no expert - but I think what you might be thinking about is country guidance cases.

Basically, rather than having expert evidence called in every single FtT case, the UT (or CoA) will give guidance based on expert evidence as to the sort of risks which exist in that country and how they need to be treated which the FtT must then follow. So if the FtT is considering deporting a gay man to Algeria and says it will be unsafe and he will be persecuted there because homosexuality is illegal - the FtT will need to look at the relevant decision (https://tribunalsdecisions.service.gov.uk/utiac/2016-ukut-65)

The list of CG cases is public - https://www.judiciary.gov.uk/wp-content/uploads/2011/03/cg-list-last-updated-28062017.pdf

Edit: Shawn’s link is probably what you are looking for! But I’ll leave this up in case it’s interesting to anyone…

That’s the one; we need to check an individual country.

Thanks both.

mmm

well be careful and double check via e.g. bailii, where the country guidance cases are also to be found.

some of those looked quite old, and situations change, and so on and so forth as it more than clear from the cases
