situation is i have a couple. husband works full time for a low wage. wife was working part time but has recently moved from ssp to esa (conts based only).

they are on the edge of wtc entitlement but wont qualify this year due to fact her wages from previous tax year will mean their taxable income will be higher in the calc than it will be in reality.

next year they might become entitled but this will depend on the outcome of any wca as this will affect taxable income.

uc is set to go live in their area in october/nov though.

what im wondering is, can i make a protected claim, get a nil award and have that allow them to complete a renewal next year when uc is fully rolled out?

When you say “wages from previous tax year” do you mean previous wages in this tax year?

if we claim now then she was in her pt employment for the whole of 16/17 and thats the figure that will be used in the calc.  this would but them above entitlement to wtc for this year.
