PIP not reinstated

Would appreciate your opinion as it doesn’t sit right…

Client was awarded PIP ER DL & Mob from 2015 to 01/10/2017 as had limited leave to remain.  Prior to leave expiring, he and his wife put in for ILR which is still being decided by HO.  Client discovered after 01/10/17 that his PIP had stopped - we rang and were told that a renewal form had mistakenly not been issued and on further investigation found that it had stopped due to his leave ending.  In the meantime the client made a new claim for PIP and a new claim could not be issued as he had no leave entitlement.  We challenged this and a new claim pack was finally issued.

We complained to PIP and received this response:

“The decision letter stated “If your award of Personal Independence Payment has an end date, you’ll be sent a letter around 14 weeks before your award ends. This letter will explain how to claim again if you want to.”

I am sorry that this letter was not sent out 25/06/17 as was advised. It appears that a system error occurred, this has since been notified and system issues fixed. However, the principle which applies across the benefit system is that the onus is on the customer (with help from family, friends, their representatives or advice centres if necessary) to make a claim at the appropriate time.

Therefore, PIP cannot be reinstated”.

This doesn’t seem fair but then very little does when it comes to PIP…
