DLA - return from abroad and over 65
A gentleman aged 75 has recently returned to the country having been away for 11 months.
DLA stopped while he was away.
On return DLA has been reinstated. However, he has been told he cannot be paid the mobility component (which he did previously have at the higher rate).
Is this correct? I have contacted DLA and was told that as they are not a decision maker they cannot say whether this is correct or not!
Please could someone signpost me to the legislation.

I have just had a chance to look at the decision. It mentions the claimant had moved permanently to France before moving back to this country.
Our gentleman moved temporarily. Do you think this would make any difference? Or is the fact that he left the UK and lost entitlement enough to mean he cannot have the mobility component back as he is over 65?
