I am assisting a client (with Downs Syndrome) who was on SDA with IS top up but received an inheritance of £50,000. His IS top up ended as did his HB ent. i am looking at the possibility of making a claim for ESA CB (as i can see from previous threads that SDA is treated as a contributory benefit for ESA when being migrated over) can anyone see any downside or difficulties with this?
Thanks

For SDA to convert to ESA(C) I think you must wait for the SoS to make a conversion decision, which does not require a new claim. I don’t think you can force a migration just by initiating a new claim. If he did claim ESA then I assume that would fail as he wouldn’t meet the contribution conditions, whereas the conversion decision would allow ESA(C) to be awarded regardless.
