Ahem… back on topic.

I have to say that we probably need to admit our own subjective approaches to this.

There are certain clients where I am relieved to get out of the room unscathed reputationally. Cases which are winnable despite the client rather than because of them. I am happy to steer such clients away from going back in for the decision. To be fair this is no more than most tribunals would hope you would do.

There are clients who are utterly drained by the experience and who I could not submit to even 2 minutes more.

There are certain tribunals where I think “please don’t explain this to me. You have no clue what you’re talking about even though you’ve made an award and I won’t be able to hide my incredulity.”
